This Privacy Policy governs the way Creekside Estate Winery collects, uses, maintains and discloses information collected from users (each, a "User") of the www.creeksidewine.com website ("Site"). This privacy policy applies to the Site and all products and services offered by Creekside Estate Winery.

We may collect personal identification information from Users in a variety of ways, when Users visit our site, place an order, When you provide express consent to receive text or email messages from us,such as subscribing to the newsletter, responding to a survey, filling out a form and about other activities, services, features or resources we make available on our Site. Personal Information we collect includes:

3. Text Messaging – Collection, Use, and Disclosure of Personal Information

Diamond Estates Wine & Spirits Ltd. dba: Creekside Estate Winery (“we,” “us,” or “our”) DOES NOT share customer opt-in information, including phone numbers and consent records, with any affiliates or third parties for marketing, promotional, or any other purposes unrelated to providing our direct services. All text messaging originator opt-in data is kept strictly confidential. Direct service providers include Third-party SMS platform providers who facilitate message delivery and manage our messaging program.

Telecommunications companies that assist us in delivering text messages to your device. These subcontractors and service providers are contractually obligated to protect your information and use it only for the purposes we specify.

SMS Messaging & Compliance

Text Message Program Terms & Conditions

By opting into our SMS messaging services, you agree to receive text messages related to our services, including appointment reminders, customer support, and important updates.

Opt-In & Consent:

By providing your mobile phone number and explicitly opting in to receive text messages from Diamond Estates Wine & Spirits Ltd. dba: Creekside Estate Winery, you provided explicit consent to non-marketing and/or marketing messages via SMS (text messaging) to the mobile number you have provided. We maintain timestamped records of all opt-in actions and comply with CASL and all other applicable laws.

Opt-Out Instructions:

You can cancel the SMS service at any time. Simply text “STOP” to the same number that sent you messages. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. All opt-out requests will be process immediately. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

-All unsubscribe mechanisms will remain functional for at least 60 days after a message is sent, as required by CASL.

Please note that if you withdraw your consent, we may not be able to provide certain services that require text messaging.

Retention of Personal Information

We retain your mobile phone number and consent records for the following periods:

Active Subscribers: While you remain subscribed to our text messaging program

Unsubscribed Users: We retain your phone number on our suppression list indefinitely to honor your unsubscribe request and comply with CASL record-keeping requirements

Consent Records: We retain records of consent for a minimum of three (3) years from the date consent was obtained, as required by CASL

After the required retention period, we securely delete or anonymize your personal information in accordance with our data retention policies and legal requirements.

Message Frequency & Data Rates

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.

Carrier Information:

Standard message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Our SMS program works with all major Canadian wireless carriers, including Rogers Wireless, Bell Mobility, Telus Mobility, and Freedom Mobile, and regional carriers.

SMS Data Protection Statement

No mobile information or consent records will be shared with third parties/affiliates for marketing/promotional purposes or any other purposes unrelated to providing our direct services. Information sharing with carriers and subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Subcontractors include Third-party SMS platform providers who facilitate message delivery and manage our messaging program.

-Personal Information Protection and Electronic Documents Act (PIPEDA) or applicable provincial privacy legislation
